Age Restriction

In line of the New Zealand's Sale and Supply of Alcohol Act 1989:

The Wine Cave NZ site is only available for use by persons of 18 years or over. By using the site, you agree that you are over 18 years old. If you are not, you must not use the site.

It is against the law for any person under the age of 18 to buy, or attempt to buy wine, or for any person over the age of 18 to buy or attempt to buy wine for any person under the age of 18. By placing an order, you confirm that you and the recipient of the wine are at least 18 years old.

All attendees of Wine Cave NZ ticketed events must be 18 years or older, we may be asked to produce photographic identification with proof of age. If you are not able to do so, you may be refused entry.

Product and Service Purchasing

It is against the law to sell or supply alcohol to anyone under 18 years of age in NZ. By placing an order, you confirm that you are at least 18 years old.

Product or Service Description & Price

All prices quoted as New Zealand Dollars with GST inclusive at The Wine Cave NZ. We reserve the right to adjust prices, offers, goods and service at our discretion at any time before we accept your order. Where an end date is specified on any offer on our site, it is intended as a guide only.

The description and prices payable for the items or services that you order are set out in our price list, brochure and/or website. Any discounted Monthly Wine Deal prices will be clearly listed. Wine Cave NZ reserves the right to amend prices without notice in the event of currency fluctuations, changes in GST or tax rates or other market conditions.

Payment Option and Policy

At The Wine Cave NZ, we use DPS Payment Express for any online purchase. DPS is New Zealand largest and most trusted provider of ecommerce secure card processing services. We also accept Ali Pay, WeChat Pay, Union Pay,and Direct Debit Transfer.

The Customer must pay for all goods (including wines, spirits or other beverages) or services at the time of ordering. If requested, invoices are issued as goods are dispatched either for physical delivery.

If we agree to give you credit&direct debit transfer, you are required to pay us in full no later than the 7 days following the date of your order ("due date"), provided that if in our sole opinion an unsatisfactory feature develops in our trading relationship with you, we reserve the right to cancel the credit period and require that you pay us immediately.

If the Customer does not make any payment to us by the due date for payment, we may charge interest on the overdue amount at the yearly rate of 2%. The Customer will be contacted by either email, letter or telephone and payment must be arranged immediately. Notice will be given at this time that at the next contact for payment an administration fee will be charged.This interest shall accrue on a daily basis from the due date until the date of actual payment (in cleared funds) of the overdue amount, whether before or after judgment. If demanded the Customer must pay us interest together with other debt collection charges incurred and the overdue amount.

We reserve the right to carry out any additional or other methods to recover the debt, including issuing proceedings.

Collection and Pick Up

If you instruct The Wine Cave at the time of placing your order, it is possible collect from 104 Carlton Gore Road, Newmarket Auckland. Your order will be available for collection for 30 days from the date on which your order is accepted, after which it will be returned and your account will be refunded, please allow 30 days for this.We are open from Monday to Saturday 9am to 6:30pm, close on Sunday and Public Holiday.

Almost everywhere around the globe, Australia, UK, Europe Union, Hong Kong, Singapore, Japan, United States and China. Quality Guarantee Policy

At The Wine Cave NZ we are committed to providing our customers with an unsurpassed level of service and are equally committed to ensuring we provide a safe and legal product.

If a wine is corked or faulty we will offer a replacement or credit on the return of the bottle in question.If a wine has been kept too long or stored inappropriately, we may not be able to offer a refund. If you believe a wine to be faulty please contact us on 0508 WINE CAVE or email [email protected]and we will be happy to make arrangements to have the wine collected and tested.

Product Subject Availability

All products are subject to their availability. When selecting the wines or other goods from our price list we try to ensure that they will remain available throughout the life of the list. However, some items will inevitably go out of stock and we will contact you immediately for substitute. If we are unable to supply a particular item, or do not supply a substitute, we will not be liable to you except to ensure that you are not charged for that item.

Products Liability

At The Wine Cave NZ, images of products on our site are for descriptive and illustrative purposes only. The Customer must advise us on the good shortage or damage in transit by contacting us on 0508 WINE CAVE or emailing [email protected] within 5 working daysand we will be happy to resolve the situation. We will not be liable for loss or damage due to the handling of goods by the Customers.

Return/Cancellation of Goods&Service

As The Wine Cave NZ, we will provide full refund and exchange of good. The Customer may return, exchange or cancel the order for goods based on the saleable condition after received the original product.

Subject to the specific cancellation provisions in relation to specific orders for goods (to be delivered), customer may contact us immediately on 0508 WINE CAVE or email [email protected] with the details. Any cancelled order will be refunded as soon as possible, but in any event within 30 days. A charge of $9GST inclusive for collections will be applied on handling fee.

If the order has been exported, upon cancellation the customer will be liable for all delivery charges incurred, and applicable taxes will also be charged back to the Customer. You may cancel any tickets to wine tasting(s), dinner services, or other services, full refunds will only be given if we are notified at least at least 14 daysbefore the date of the event. Refunds will only be given after this time if we are able to re-sell your tickets, dinner service, or other services.

From time to time The Wine Cave NZ may offer other services, special offers, discounts, promotions etc together with services not specifically referred to in these terms and conditions. Such matters shall be subject, in addition to these terms and conditions, to specific terms and conditions. By accepting the service or special offers, discounts, or promotions you agree to be bound by such additional terms and conditions.

The Customer's privacy is important to us at The Wine Cave NZ and we want to be sure that you understand the terms and conditions relating to the way in which we collect information and the use of that information.As part of our operations we may gather certain types of information about the users of our site, such as your usage statistics &Personally Identifiable Information etc. We may also record your contact details, credit information and any related personal details that you supply or that we obtain independently.

You acknowledge that we, our employees, carriers, contractors and agents may use or disclose any of the information identified in the previous paragraph for purposes connected with the supply of the services to you. You may at any time make a written request to see any personal information that we hold or to ask us to correct any mistakes in that information

Intellectual Property Rights

The Wine Cave have all the right to own, use and provide the website to all the content including text, images, articles, photographs, illustrations, audio and video clips. You may electronically reproduce and store the content of the website solely for the purposes of viewing, using the services or saving website content, for your own personal use.

You may not display or distribute the content of any part of the website or its content in public, including any reproduction in any form on the Internet, without our express permission.

Any infringement of our intellectual property rights will be fully enforced under New Zealand law.

Membership Account

Amendments & Applicable Law

At The Wine Cave may change the terms of this agreement by sending you notice ("amendment notice") to that effect by your preferred contact method and supplying you with the amended agreement. Once the agreement is modified, will take effect from the date stated on the amendment notice but no later than 30 days following the date that we send the amendment notice.
